1. RETAIL TERMS


1.1 These Terms and Conditions of Sale (“Terms of Sale”) are the terms and conditions on which Hygge Flower Studio (“we”, “us” or “Hygge Flower Studio”) provides products to you, which includes flowers. Your purchase of products from us through this website or via any other method (e.g. in person or email) is subject to these Terms of Sale. Please read these Terms of Sale carefully before ordering any products from our site or via any other method. By placing an order for any of our products, you agree to be bound by these Terms of Sale.

1.2 If you place an order through our website, you are agreeing to these Terms and Conditions and our Privacy Policy by clicking the ‘Place order’ button in the checkout section.

2.1 hyggeflowerstudio.com is a website operated by Hygge Flower Studio, whose trading address is Hygge Flower Studio, White Post Nursery, Langford Budville, Wellington, Somerset TA21 0RW

3. OUR SERVICE TO YOU


3.1 Our purpose is to create and provide you with fresh and beautiful flowers and flower arrangements of the highest quality, while also providing an excellent service.

3.2 Hygge Flower Studio offers an ordering and collection service in Langford Budville, Wellington, Somerset. 

Our operating hours are stated in the footer of our website, on our social media account and on our Google Business profile. Hours may vary in the case of unforeseen circumstances.

For your convenience, we provide an online service to order your floral arrangements. Click on the relevant page and item to view the options for each product. Once you have chosen your option, you will be led through to check out where you can place your order.

PLACING AN ORDER

3.3 When you place and complete an online order with us via our website, we will automatically send a “Confirmation Email” to the address provided at check out. We will confirm that your order has been received and will provide you with an order number.  It will help us if you can tell us the order number whenever you contact us.

The contract to supply the products detailed on the email will be made between you and us, and will only be formed when you have been sent the Confirmation Email. 

3.4 To ensure a good line of communication with you, should we need to contact you, please make sure you provide the correct email address and telephone number before placing your online order via the ‘place order’ button. When you receive your confirmation email, we recommend you check the details and let us know immediately if you see an error.

3.5 If  you place an order for products by email or in person, our contract will be formed once payment has been received. We will require your contact details at this point in case we need to contact you again regarding your order.

COLLECTION

3.6 When you place an online order via our website, you will be given the option of a preferred collection date. This date will be confirmed on the Confirmation Email mentioned above. If you do not collect the products from us on the requested day/date, or you do not notify us to rearrange your collection, we will attempt to contact you for further instructions. If despite our reasonable efforts, we are unable to contact you or re-arrange your collection, we may end the contract. 

3.7 We will strive to provide the smoothest and most stress-free collection service possible. However, we are not responsible for delays outside our control such as bad weather and/or delayed delivery of products from our supplier. If this happens, we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay.

3.8 As mentioned in 3.4, we require the correct email address and telephone number for you to avoid problems or delays on your collection day, should we need to contact you. Please make sure you have provided a valid email and telephone number so that we can notify you if we encounter any difficulties. 

3.9 Hygge Flower Studio’s desire is to provide a quality service to you. Therefore, if there is a problem with your product regarding the quality or for any other reason, we should be the first point of contact to discuss the issue. We recommend that upon collection of your product, you inspect your arrangement immediately and let us know if you have any issues. Once the product has left the premises, we will assume there are no problems with your order.

4. FLOWER PRODUCTS


4.1 Flowers are natural, perishable products and some variation in size, colour, shape and texture as advertised is to be expected. You understand and accept these variations may occur. Flower orders are subject to availability, and in the event of supply difficulties we may decide to substitute a product with one of similar appearance, quality and value without notice. You acknowledge and agree that this may on occasion happen and accept the substitution(s).

The packaging of the product may also vary from that shown in images on our site and is subject to availability. 4.1 also applies to packaging.

4.2 If you have any allergies and are concerned about the supply of certain flowers, please contact us before placing your order. Unfortunately we are unable to guarantee that any of the flowers provided to you are allergen free. Also, if you have concerns regarding flowers which may be harmful or poisonous, please contact us before placing your order.

4.3 We will provide a flower care guide with each order. It is important to follow these care instructions to get the best from your flowers. Alternatively, please contact us should you have further questions about caring for your flowers. We will be unable to replace or refund flowers if the care instructions have not been followed correctly.

4.4 You agree that we will choose the flowers to create your floral arrangement, unless you have specified particular flowers or colours to be included as part of the check out process. Please make a note in the box of your request. Your request will be granted depending on the season and availability of the flower or colour you have requested. Any vessels i.e. vases, containers, bowls etc shown as part of the designs on our website, are not included with your order and have been used for design and advertising purposes.

4.5 Flower arrangements and product packaging shown on our website are for illustrative purposes only. We have made every effort to display the colours as accurately as possible. However, we cannot guarantee that your device will display the colours as accurately as we’d like so please note, your floral arrangements may vary slightly from those images.

5. PRICE AND PAYMENT


5.1 Prices listed on our website (or provided to you by any other method) include VAT

5.2 We try to ensure that the prices shown on our website are error free, sometimes errors may occur. Prices will be verified as part of the ordering process, however, if a typographical or administrative error is made we will notify you immediately of the correct price before your product is created. You will have the option to accept or decline the corrected price.

5.3 Payment can be made in person or via our online checkout service, if placing an order online. We use Square payment system to collect payment, accepting credit and debit cards. Once your order has been placed and confirmed, payment will be authorised and transferred from your account.

6. CANCELLATION & REFUNDS


6.1 Please email us or visit the studio to make an amendment or cancel your order. Should you wish to amend or cancel your order before we have ordered the flowers from our supplier, and started to create your order, we will honour the amendment or, if you prefer, refund the amount back to your original method of payment. 

6.2 Should you wish to cancel your order after we have ordered the flowers from our supplier, and/or started and/or completed your order, we will be unable to make any amendments or refunds and you will be charged. Our decision is final as to whether the order is classed as started and/or completed. 

6.3 If your order is incorrect or faulty, and you have followed the instructions as per 4.3, you will be entitled to a refund or replacement of the product. In the event there is a problem, and due to the perishable nature of the flowers, you must contact us within one hour of receiving the order. This will enable us to review, assess and assist you in resolving the complaint quickly. You accept and acknowledge that our decision on such matters will be final.

6.4 Should we need to cancel your order (the product you ordered is unavailable, your payment was declined, or we have found an error with our product price or description), we will contact you immediately to notify you of this course of action. In the event you have paid for the product, we will refund the amount back to your original method of payment.

6.5 In the instance your order cannot be fulfilled due to staff illness, we will contact you immediately to let you know. In such circumstances, we will offer you an alternative date for your order to be collected, or a refund if you prefer. You acknowledge that we shall have no other liability to you for any loss or damage that you may suffer as a result of such circumstances detailed in section 6.


7. OUR LIABILITY

7.1 We will not be liable to you if we are prevented or delayed from complying with our obligations due to events which are beyond our reasonable control. 

7.2 We are only responsible for losses that are a natural, foreseeable consequence of our breach of these Terms of Sale or our failing to use reasonable care and skill, and we are not responsible for any loss or damage that is not foreseeable. Losses are foreseeable where it is obvious that they will happen.

7.3 In any event, we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues, lost business opportunity or business interruption 

7.4 You must follow any advice we give you to keep products we supply to you safe (including any instructions or product manuals provided with the products). We cannot accept liability for damage to products we have supplied which is caused by your failure to follow this advice. 

7.5 We shall not be liable in respect of any allergic reactions occurring due to flowers or other material used in any arrangements, or if any staining or discoloration occurs due to the arrangements, unless instructed by you not to use particular flowers or materials or (in the case an allergic reaction) caused by our negligence. 

8. INTELLECTUAL PROPERTY (IP)

8.1 Hygge Flower Studio retains ownership of all intellectual property rights. Any content and other information provided to you in relation to your order,, such as (but not limited to) drawings, artwork, photographs, mood boards, proposals, arrangements and displays, should not be used, modified or copied for commercial, personal or other use, without our prior written consent.

8.2 Credit must be given to us in any social media photography that you take, using the hashtag #hyggeflowerstudio
